The website www.easi-spare.com (hereinafter referred to as the "website") is published by the company TECHNIC-ACHAT (hereinafter referred to as "EASI-SPARE").
The company EASI-SPARE is active in the sale of industrial supplies and automation components. Sales can be made via the website www.easi-spare.com. The website is the property of EASI-SPARE.COM in its entirety, as well as all the related rights. Any reproduction, in whole or in part, is always subject to the authorization of the owners. However, hypertext links to the website are permitted without specific requests.
1. Identification of the tenderer:
The seller is the French company TECHNIC-ACHAT, SARL (Ltd.) with a capital of €7,500. The head office is located 9, rue du Lugan 33130 BÈGLES (FRANCE), and the company is registered at the Registre du Commerce et des Sociétés de Bordeaux (Bordeaux trade register) under the number 497 738 914 00 025.
2. Acceptance of the Terms and Conditions:
The customer acknowledges having read, at the time of placing the order, the particular conditions of sale stated and expressly declares to accept them without reserve. The present General Terms and Conditions of Sale govern the contractual relationship between EASI-SPARE and its customer, both parties agreeing to them without reservation. These General Terms and Conditions of Sale shall prevail over all other terms and conditions contained in any other document, except prior, express and written derogation.
The products offered on the catalogue and the website are products from a selection of the offers of EASI-SPARE partners. Photographs illustrating the products are outside the scope of the contract. In the event of errors, EASI-SPARE cannot be held liable under any circumstances.
Any order placed by telephone, fax or email must be confirmed by the customer in writing with indication of the delivery time, the details of the service and the agreed price, followed by the words "signed and agreed". The parties expressly acknowledge that the e-mails as well as the automatic recording systems used on the website shall be considered as proof between them and may be relied upon against them in particular as regards the content, the date of the order and the delivery time. EASI-SPARE.COM shall confirm the acceptance of the order to the client at the e-mail address that the client will have provided. The sale will not be concluded until the confirmation of the order. EASI-SPARE.COM reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. If EASI-SPARE.COM refuses the order for any reason, the order will be automatically cancelled. In case of refusal of the order by EASI-SPARE.COM for any reason whatsoever, the order shall be automatically cancelled. An e-mail informing the client of this refusal and its reason will be sent by EASI-SPARE.COM. The information provided by the purchaser when placing the order binds him. In the event of an error in the recipient's details, the seller shall not be held responsible for the impossibility of delivering the product. Under no circumstances may a validated order be modified or cancelled by the customer if it has already been processed by EASI-SPARE.COM.
Cash on delivery and taxes
In the case of a so-called "cash on delivery" system, the customer undertakes to pay the carrier or his representative the full amount indicated in the order confirmation. In addition, for deliveries outside metropolitain France, the customer undertakes to pay all taxes due on the importation of products, customs duty, value added tax, and any other taxes due under the laws of the country where the order is received. EASI-SPARE.COM shall not be held legally responsible if the taxes are not paid by the customer. Control upon receipt: In the case of a technical product, the customer shall particularly check the proper functioning of the delivered device and read the instructions provided. In the event of apparent defects, the purchaser benefits from the right of return under the conditions set out in this document. War, riots, fire, strikes, accidents and inability of being supplied are considered as cases of force majeure discharging the seller of his obligation to deliver. Goods always travel at the risk of the consignee. EASI-SPARE shall not be held responsible for any damage during transport. For reasons of availability, an order may be delivered to the customer in several times. The customer then pays only one delivery. If the customer wants two places of delivery, he must place two orders, with the related shipping costs. Delivery time: The delivery times are given as an indication only. However, if after a period of 21 working days after the indicative date of delivery, the ordered product has not been delivered for a reason which is the responsibility of EASI-SPARE, except in cases of force majeure, the sale may be cancelled at the request of the customer by sending an e-mail to EASI-SPARE.COM at firstname.lastname@example.org, unless it is not has already been processed by EASI-SPARE. No compensation and/or penalty for delay may be requested from EASI-SPARE, even in the event of cancellation of the order by the customer under the conditions described above. Choice of transport: Please note, if you do not choose the right delivery for your status (private or professionally), we do not guarantee the delivery.
You have 14 days (from receipt of the items) to decide. To do so, you will need to obtain a return number from EASI-SPARE. In order for the return to be accepted by EASI-SPARE, the product must be returned in its original packaging without having been opened. In case of exchange or refund, return the item(s) new in its (their) original packaging, intact, with any of its (their) accessories, instructions and documentation, to the following address: TECHNIC-ACHAT 9, rue du Lugan 33130 BÈGLES FRANCE. In the event of exercising the right of withdrawal, EASI-SPARE shall refund the sums paid by the client, free of charge, except for shipping and return costs. The refund shall be made within a maximum period of 15 days. (cf. Gallonet law).
7. Description of the price of the products proposed:
Prices are expressed in euros excluding taxes. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and transport costs. EASI-SPARE reserves the right to change its prices at any time and without notice.
The price charged to the customer is the price indicated on the order confirmation sent by EASI-SPARE. Payment by credit card: The customer has the possibility to pay the order via the website. Payment by bank transfer or PayPal: The order validated by the customer will only be considered effective when EASI-SPARE has received the transfer on the account. Deferred payment: Any order placed on the website is payable according to the conditions mentioned in the contract binding the two parties. The only means of payment accepted are the means set out in the contract. Late payment: "Any sum, including the down payment, not paid on its due date will automatically generate interest for late payment equivalent to three times the legal interest rate in force, as well as the payment of the fixed allowance for costs of recovery of €40, as provided for in Article L. 441 -6 of the French Commercial Code in accordance with the legislation in force on 1 January 2013."
Invoices will be sent electronically to the address provided at the time of payment. A paper invoice can be sent to you by post upon explicit request.
Returns, except in the event of withdrawal, shall only be granted upon prior acceptance by EASI-SPARE. To do so, the customer shall obtain a return number from EASI-SPARE. Return costs are the responsibility of the customer. For the return to be accepted by EASI-SPARE, the product must be returned in its original packaging without having been opened. The return must be made to the following address: TECHNIC-ACHAT 9, rue du Lugan 33130 BÈGLES FRANCE. Upon receipt of the return, and subject to acceptance of the return, EASI-SPARE will proceed with the the reimbursement of the amount including tax and VAT initially charged to the customer, deducted from shipping costs (non-recoverable), from the costs of testing and reconditioning of the equipment. EASI-SPARE will credit the customer's bank account within a maximum period of 30 days.
This contract is subject to French law. EASI-SPARE cannot be held liable for damages of any kind, whether material, immaterial or physical, which may result from a malfunction or misuse of the products sold. The same shall apply to any changes to products resulting from manufacturers. The liability of EASI-SPARE shall, in any case, be limited to the amount of the order and shall not be held liable for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution in particular with the help of: a professional association of the sector, an association of consumers or any other council of his choice. It is recalled that the search for an amicable solution does not interrupt the "short term" of the legal guarantee nor the duration of the contractual guarantee. It is reminded that, as a general rule and subject to the judgement of the Courts, compliance with the contractual guarantee provisions of this contract requires the buyer to honour its financial obligations to the seller. Complaints or disputes will always be received with attentive benevolence, and good faith will always be presumed on the part of those who take the trouble to expose their situations. In the event of a dispute, the client shall first seek an amicable solution from the company. In all cases, EASI-SPARE shall not be held liable for non-compliance with the regulations and laws in force in the country of reception, the liability of EASI-SPARE is systematically limited to the value of the product in question, the value at the date of sale, and this without any possibility of recourse against the brand or the company producing the product. In any event, the client benefits from the legal guarantee of eviction and hidden defects (Art. 1625 et seq. of the French Civil Code). Provided that the purchaser proves the hidden defect, the seller must legally compensate for all consequences (Art. 1641 et seq. of the French Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (Art. 1648 of the French Civil Code). The provision of personal information collected for the purpose of distance selling is mandatory, as this information is essential for the processing and delivery of orders, and for drawing up invoices and guarantee contracts. Failure to provide information will result in non-validation of the order. In accordance with the law "Informatique et Libertés" (Data Protection Act), the processing of personal information relating to customers has been the subject of a declaration to the French data protection authority (CNIL). It is kept for an indefinite period of time and is intended for marketing, sales and logistics departments. The client disposes (Art. 34 of the law of January 6, 1978) of a right of access, modification, rectification and deletion of data concerning him, which he may exercise with EASI-SPARE.COM.
